TERMS and CONDITIONS

The purchase of packages (hereinafter referred to as the "Services") offered by BEYOND VACATIONS L.L.C. constitutes a contractual agreement between BEYOND VACATIONS L.L.C. and the customer and implies your acceptance of BEYOND VACATIONS L.L.C.' Terms and Conditions described hereinafter in the sections "Things To Know Before You Go" and "Other Terms and Conditions". Please ensure you read carefully and understand these Terms and Conditions prior to booking.

BASE PRICE INCLUDES:
Airport/hotel round-trip transfers at all destinations unless otherwise advised. Accommodation for the duration of stay, in accordance with the vacation package and hotel category selected. Hotel taxes and service charges (unless otherwise advised), Air tickets when stated in the package.

PRICES DO NOT INCLUDE:
Personal expenses. Telephone and data port charges at some hotels. Meals and drinks, unless otherwise specified as part of a vacation package, travel insurance.

PAYMENT CONDITIONS
A deposit of €300 per person is required at time of reservation. Final payment must be received by the BEYOND VACATIONS L.L.C. office at least 35 days prior to your departure.
Train tickets, Internal flight tickets, Concert tickets should be paid in full and are 100% non-refundable.

CANCELLATION FEES
36 days or more prior to departure: €300 per person
35 days or less prior to departure: 100% of the total cost of the holiday package per person, including taxes and service charges.

MODIFICATIONS
Changes are permited 36 days prior departure at no extra fee.
35 days or less prior to departure, fees will be adjusted to reflect true value of the changed package.

Please note that the days mentioned are normal business days and that the day of departure is not calculated for the purpose of the cancellation charges. No refunds will be made by BEYOND VACATIONS L.L.C. for Services either cancelled or unused subsequent to departure. Insurance premiums are non-refundable packages, in whole or in part, whether cancelled before or after the departure date. All cancellation fees must be calculated based on the total amount of the products and Travel Services purchased including all the taxes.

CHARITIES
Payment to charities will only take effect at the end of our fiscal year. BEYOND VACATIONS L.L.C. will provide you with a copy of the donation made to the charity of your choice. BEYOND VACATIONS L.L.C. will donate 20% of its profit after all expenses are paid including, salaries, office expenses, utilities and site inspections.

Other terms and conditions

1. PRODUCT DESCRIPTIONS
BEYOND VACATIONS L.L.C. has put forth all necessary efforts to ensure that, at time of publication, all products' descriptions on this web site are accurate. For several reasons beyond the control of BEYOND VACATIONS L.L.C., modifications can take place during the season which may affect products' descriptions. These modifications will be noted and BEYOND VACATIONS L.L.C. computer reservation link will be updated accordingly. It is the travel agent's responsibility to advise the customer of these modifications. No representative of BEYOND VACATIONS L.L.C. is authorized to alter or ignore any of the provisions hereof.

2. PRICES INDICATED
Prices are quoted in EURO. Prices in GBP and USD are informative and may vary with the official exchange rate unless otherwise indicated, and are based upon the prices of service providers, the exchange rate, taxes and other fees in force at time of preparation of the site. All prices are valid upon date of publication and are subject to change without notice. Unless the customer has paid in full, all prices may be increased at any time and for any reason. Price reductions are applicable to new bookings only.

3. RESERVATIONS
Reservations are strictly personal and must be accompanied by a deposit or payment in full before they can be considered confirmed. Unless otherwise indicated in these Terms and Conditions, all amounts are per person.

4. FINAL PAYMENT
Unless otherwise indicated in the section of these Terms and Conditions titled, final payment must be received by BEYOND VACATIONS L.L.C. at least forty-five (45) days prior to the date of departure. Reservations made less than forty-five (45) days prior to the date of departure must be accompanied by payment in full. If final payment is not received within the required period, BEYOND VACATIONS L.L.C. reserves the right to cancel any such reservations without prior notice and levy applicable cancellation fees as indicated in the section of these Terms and Conditions.

5. PAYMENT BY CREDIT CARD
Verbal authorization given by the customers to BEYOND VACATIONS L.L.C. for the use of a credit card confirms the reservation, whether or not the draft is signed. However, upon request by BEYOND VACATIONS L.L.C., customers must stipulate in writing that the credit card may be used without their signature. Once a credit card number has been forwarded to BEYOND VACATIONS L.L.C. to guarantee a reservation, BEYOND VACATIONS L.L.C. becomes responsible for payment and must keep a signed copy of the customer's authorization on file. In the event that credit card charges are contested, a copy of this authorization must be sent to BEYOND VACATIONS L.L.C. before any decision can be made.

6. FLIGHTS AND CARRIERS
Customers acknowledge and accept the following:

Changes: Flights offered by BEYOND VACATIONS L.L.C. are conducted in accordance with the applicable tariff of the air carrier and pursuant to regulations set out by the country of origin. All such flights and rates are also subject to approval by the relevant government authorities. Consolidations and changes in the published schedule, aircraft type, days of operation, air carrier providing air transportation, and flight itinerary may be undertaken at any time and without prior notice, in accordance with the air carrier's tariff.

Schedule Check and Connecting Flights: Flight schedules are subject to change without notice. All customers having purchased a package including air with BEYOND VACATIONS L.L.C. must check the flight schedule with the airline 24-hour prior to the departure and the return date. BEYOND VACATIONS L.L.C. undertakes to notify customers reasonably in advance through means it deems appropriate of any schedule changes resulting in the advancement or delay of the flight departure times or in case of cancellation of a flight. Whenever customers book connecting flights, they have the responsibility to allow themselves sufficient time to make the connection. No control can be exercised over air carriers to guarantee flight schedules, which may be altered or affected by various circumstances.

BEYOND VACATIONS L.L.C. will not be liable for any change of schedule or a missed flight connection, including any additional fees incurred and special, incidental or consequential damages (including the carriage of baggage) arising from the foregoing, whether or not it had the knowledge that such additional fees or damages might be incurred.

Airport check-in: It is recommended that customers arrive at the airport check-in counter at least two (2) hours prior to departure, failing which their reservation may be cancelled and their seats assigned to other customers, with no right of recourse.

Other applicable conditions: Air transportation is subject to all applicable government regulations and is governed by the Montreal Convention, or the Warsaw Convention as the case may be, the applicable tariffs of the air carrier as well as the conditions of contract appearing on the airline ticket. Once filed with and approved by federal regulatory authorities, any amendments or changes to the applicable air carrier's general terms and conditions of carriage are not subject to additional public notice and are legally binding.

Refusal to transport - Removal of passengers: BEYOND VACATIONS L.L.C. shall not be liable for neither refusal by itself or the air carrier to transport a passenger nor for the cancellation of a reserved space or removal of a passenger due to, but not limited to, safety reasons, to prevent the violation of any applicable laws of any country or to prevent any hazard or risk to such passenger, to any other person or property, or to the flight.

7. VALIDITY OF TICKETS
Tickets are made out in the name of the customer and are not transferable. Tickets are valid only on the dates and flights indicated. Unused portions of tickets may not be used for travel on other flights and are not subject to refund at any time.

8. MINORS
Air navigation orders adopted by the Ministry of Transport allow infants under two (2) years of age (at date of completion of travel) to travel free of charge, provided they do not occupy a seat (flight reservation must be made) and no meal service is provided.

9. BAGGAGE
Limits: Air carriers have individual rules and regulations with respect to baggage weight, size and number. Customers must consult with the airline for applicable restrictions.

Liability: The provisions of the Montreal Convention, or the Warsaw Convention, as the case may be, the applicable tariffs of the air carrier, as well as the notice appearing on the passenger ticket and baggage check, govern the loss of and damage to baggage and establish the limits of the air carrier's liability.
Baggage lost or damaged while boarding or disembarking a ship must be reported to the Purser's office prior to the ship's departure from port or prior to leaving the local customs area. Passengers' baggage and property are transported, stored and handled at owner's risk at all times.

10. INSURANCE
Customers may purchase travel insurance, including trip cancellation insurance and out-of country health insurance, at time of booking. For information and details about the travel insurance plan best suited to their needs and the cost for such plan, customers are advised to consult with their insurance provider.

11. TRAVEL DOCUMENTS
It is the full responsibility of customers to obtain at their own expense all necessary travel documents required by all relevant government authorities, including all ports of call, and to comply with the laws thereof. Under applicable laws, all guests must complete the advance cruise guest registration form prior to leaving the country. Failure to do so can result in denied boarding at the pier. Citizens born in certain countries may require a visa in addition to a valid passport. One (1) parent traveling with a child under age eighteen (18) may have to obtain a notarized letter of consent signed by the parent not traveling. Customers are responsible for checking which documents are required, and then making certain that they have the necessary documents in hand prior to departure. Customers failing to provide the required documents may be denied boarding privileges by the carrier or relevant authorities, without further recourse or the possibility of a refund. Entry to another country may also be refused even if the required information and travel documents are complete. No refund or replacement will be given for lost or stolen travel documents.

BEYOND VACATIONS L.L.C. shall not be liable for any aid or information given by its employees or the travel agent in connection with obtaining any necessary travel documents or complying with any laws, whether given orally, in writing or otherwise, or for the consequences suffered by any customer resulting from his/her failure to obtain such documents or to comply with such laws.

12. CUSTOMER ADVISORY
Some events are part of normal unpleasant occurrences which can happen when traveling abroad. The customer realizes this, solely assumes the consequences thereof and agrees that BEYOND VACATIONS L.L.C. cannot be held responsible for any damages owing to such occurrences.

Living Standards: Customers are asked to bear in mind and accept that living standards, religion, local practices and the political system at the destination, and the conditions there with respect to the provision of utilities, services and accommodation, may differ from those found in their country of origin.

Service disruptions: Some services including water, electricity, air-conditioning, security, sanitary conditions, pools, food, beverages and other services or benefits may be suspended or interrupted partially or completely during the customer's stay.

Food, water and beverages: The food, water and beverages may not be up to North-American and European standards. Accordingly, customers assume sole responsibility for any illness suffered while abroad or upon return owing to the quality of the food, water and beverages.

Insects: Insect life thrives in certain climates and makes no distinction between budget or higher-priced hotel accommodations.

Construction: To maintain the quality of services, hotel complexes must regularly undergo maintenance, improvement and renovation work and, in some instances, consider expansion. Whenever construction or renovation work that is likely to interfere with the use and enjoyment of any accommodation is brought to the attention of BEYOND VACATIONS L.L.C., every reasonable effort will be deployed to promptly notify customers.
Holidays, school breaks, elections and conventions: Customers may be subject to certain inconveniences, such as cancellation or unavailability of some services, when traveling during periods designated as school breaks, other holidays, elections or conventions. Because these periods vary according to country and relevant authorities, it is practically impossible for BEYOND VACATIONS L.L.C. to provide any indication of such dates. Customers acknowledge and solely assume the possible consequences of traveling during these periods.

13. ROOM ALLOCATION
Hoteliers are solely responsible for room allocation, in accordance with the category reserved by customers. Should customers choose to alter their room category upon arrival at destination (upon availability), they must make their own arrangements with the hotelier and assume all additional fees levied by them. Special requests concerning, bed types, room amenities and location can be forwarded to the hotelier, but they do not constitute on any account a confirmation.

14. CHECK-IN AND CHECK-OUT CONDITIONS
Customers acknowledge and accept that hoteliers, in accordance with international standards, request that occupants check in between noon and 3 PM and check out by noon on the scheduled day of departure or by noon on the day immediately preceding an early night departure. The hotel will advise the customer of the check-out time when he/she checks in at the hotel. Whenever meals and/or drinks are included in the package, customers are eligible for meal and drink services from the time they check in to the time they check out.

15. HOTEL PHOTOGRAPHS OR PICTURES
Photographs or pictures appearing in the BEYOND VACATIONS L.L.C. products' descriptions on this web site should be used solely as an indication and shall not be construed as part of these Terms and Conditions. Customers are advised to make their selection according to price, location and services offered. Decor and furnishings may vary from room to room or from cabin to cabin, in accordance with the individual location on the hotel premises or on the ship.

16. CUSTOMERS REQUIRING CARE AND ASSISTANCE WHILE TRAVELLING
All customers requiring special care, assistance, attention or treatment must advise BEYOND VACATIONS L.L.C. and the air carrier of any and all specific needs at the time of booking, in order to arrange air transportation, hotel, cruise and coach tour accommodations.

17. CHANGES TO TRAVEL SERVICES
If confirmed Travel Services are no longer available prior to the departure date or subsequent to arrival at destination, BEYOND VACATIONS L.L.C. reserves the right to substitute them for comparable alternate Travel Services, or, alternatively, to cancel them. If the substituted Travel Services are of lesser value, the liability of BEYOND VACATIONS L.L.C. shall be limited to the sole difference in cost. If the substituted Travel Services are of greater value, the customer will be required to disburse an amount equal to the difference between the price of the Travel Services purchased and that of the substituted Travel Services. The customer will be entitled to refuse such substitutions. In such a case, and in the event of a cancellation, the liability of BEYOND VACATIONS L.L.C. shall be limited to the reimbursement of the price of Travel Services paid by the customer.

18. INSOLVENCY PROTECTION FOR CUSTOMERS PURCHASING IN UNITED STATES OF AMERICA
In order to protect the economic interests of purchasers leaving from the United States of America in the case that BEYOND VACATIONS L.L.C. becomes insolvent, a special bank account has been established for customer payments, which will be held "in trust" and not drawn upon until after the customer's departure. This special protection is free of charge for American customers.

19. CUSTOMER RESPONSIBILITY
Customers are responsible for advising BEYOND VACATIONS L.L.C. of their intentions, expectations and needs, as they relate to the proposed travel, before the reservation is completed.

Health: Customers whose physical condition so requires must ensure that they have a sufficient quantity of any required medication with them, and that they must carry such medication in their hand baggage at all times. Customers must also consult competent medical authorities prior to departure about preventive medical measures to be taken as regards to the countries to be visited.

Pregnancy: The cruise lines will not accept passengers who will have entered their 24th week of pregnancy by the time their travel concludes. A medical certificate establishing the due date and fitness to travel is required.

The air carrier may refuse pregnant passengers for whom air travel may involve a risk to themselves or their unborn children. A medical certificate establishing the due date and fitness to travel may be required prior to departure.

Sports and activities: Descriptions of sports and other activities contained in the products' descriptions on this web site are provided for information purposes only and are not meant to incite the customer in any way. BEYOND VACATIONS L.L.C. cannot be held responsible for any accident or mishap occurring at the destination during the practice of any sport and/or activity in which the customers participate of their own free will and initiative.

20. FORCE MAJEURE
BEYOND VACATIONS L.L.C. shall not be liable for failure in the performance of any of its obligations, including without limitation, for any loss or damage resulting from any delay, cancellation, adverse weather conditions, loss of personal belongings, illness, bodily injury, accident, death, deterioration of Travel Services, inconvenience, loss of enjoyment, disappointment or frustration, either mental or physical, due to:

- An Act of God or Force Majeure or third party wrongdoing;
- A war, revolution, insurrection, riot, blockage, terrorism or act of terrorism, or any other unlawful act against public order or authority;
- Fire, flood, explosion, earthquake, epidemics, quarantine, storm, lightning, hurricane, tropical storm, tornado or tropical storm;
- Accident to or failure of an aircraft or equipment used in connection therewith, loss of or hijacking of an aircraft, or any shortage of or inability to provide labor, fuel or facilities;
- Any strike, lock-out, labor dispute or other industrial disturbance whether involving BEYOND VACATIONS L.L.C.' employees, the employees of its service providers or others upon whom BEYOND VACATIONS L.L.C. relies;
- Any government order, regulation, action or inaction or any failure to obtain the approval of a government authority having jurisdiction in the circumstances as may be required to the conduct of operations hereunder or any government or legal restraint upon such operation;
- Others upon whom BEYOND VACATIONS L.L.C. relies for the performance of the whole or any part of any Travel Services hereunder;
- Any other causes beyond the reasonable control of BEYOND VACATIONS L.L.C. and any other event not reasonably to be foreseen, anticipated or predicted, whether actual, threatened or reported, which may interfere with the operations of BEYOND VACATIONS L.L.C. or of its service providers.

21. EXCLUSION OF LIABILITY
BEYOND VACATIONS L.L.C. makes arrangements with air carriers, hotels, transfer operators, cruise line and other independent parties to provide customers with Travel Services they purchase. Although BEYOND VACATIONS L.L.C. takes great care in selecting these service providers, it does not have any control over them and cannot be held responsible for their omissions, fault or negligence, or that of their employees, nor for any loss or damages suffered as a result thereof. Travel Services provided are subject to the conditions imposed by the service providers and their liability is limited by their tariffs, conditions of carriage, tickets, vouchers, international conventions and agreements.

22. ACTIVITIES AND SERVICES NOT INCLUDED
BEYOND VACATIONS L.L.C. shall not be liable for the quality or safety of activities and/or services (such as excursions, optional tours, activities, little extras and others) available at destination that customers may wish to participate in and which are not included in the package, nor for any other representation made by the operator of any such activities and/or services. Any written or oral contract for all such activities and/or services shall be deemed to be made between customers and the operator of such activities and/or services and shall be undertaken at the customers' own risk of loss, damage or injury. BEYOND VACATIONS L.L.C. shall not be liable in any manner for any complaints or claims that may arise as a result of participation in any such activities and/or services which are offered by third parties over whom BEYOND VACATIONS L.L.C. has no control.

23. CONFIDENTIALITY
BEYOND VACATIONS L.L.C. strictly complies with principles of confidentiality with respect to customers' personal information, including in accordance with the Personal Information Protection and Electronic Documents Act.

24. COMMENTS AND COMPLAINTS
At destination, customers must contact the service provider that BEYOND VACATIONS L.L.C. uses or the hotel manager immediately to get his assistance and to remedy any problem without delay whenever such problem can be reasonably remedied. If a problem cannot be solved or dealt with immediately, customers are requested to forward the specifics of the incident in writing to their travel agent within thirty (30) days of their return to point of departure.

25. LAWS
This agreement is governed by the laws of the State of California. Any legal action instituted against BEYOND VACATIONS L.L.C. must be heard before the courts of this State. For the purposes of any such proceedings, the parties hereby agree to elect domicile in the judicial district of the US gateway city in question. The voiding of one or other of the clauses hereto shall neither annul nor invalidate this agreement which is known as the "Terms and Conditions".
